WELCOME TO APPTISMO, BEFORE USING OUR SERVICES, PLEASE READ THE FOLLOWING TERMS OF USE CAREFULLY:

Apptismo is an application dedicated to developing speech skills and promoting autonomy and support in daily life for people with Autism Spectrum Disorder (ASD). By accessing or using the Apptismo Platform, you (hereinafter "User") fully agree to these Terms of Use ("Terms"), which constitute a binding legal contract with the Individual Microentrepreneur Jackson Hugo Bandeira de França, headquartered at Rua Coronel Manoel Bandeira, nº 90, Bacuri neighborhood, Imperatriz – MA, ZIP 65916-020, registered under CNPJ nº 45.035.174/0001-28 ("Developer").

Apptismo was developed to assist parents, guardians and professionals with the objective of helping and stimulating communication development in people with ASD, offering interactive resources that promote the evolution of speech skills.

We recommend that you read these Terms carefully and consult them periodically, as any changes will be published on the Platform and, when possible, communicated through our official channels. If you have any questions, contact us through the "Contact Us" available in the application.

1. OBJECT AND PURPOSE

1.1 Application Objective:

Apptismo aims to assist in stimulating the development of speech, communication and autonomy skills for people with ASD.

1.2 Scope of Services:

The Apptismo Platform enables Users to:

Exercise speech and expression stimulation through the use of customizable cards.

2. USERS AND USAGE RESTRICTIONS

2.1 Target Audience:

Adults: Any individual interested in using Apptismo Services can download the application from authorized stores, provided they accept these Terms.
Minors under 18: The use of Apptismo is permitted only with the supervision and authorization of a legal guardian. If you fall into this condition without proper supervision, we recommend that you do not use the Platform.

3. SERVICES OFFERED

3.1 General Features:

Apptismo aims to assist in stimulating the development of speech, communication and autonomy skills for people with ASD.

3.2 Card Creation and Photo Usage:

Card Creation: Apptismo allows Users to create personalized cards, which may include texts, images and other graphic elements.
Photo Usage: When uploading photos for card creation, you declare that you have all rights to the images or have obtained the necessary authorizations. In the case of photos containing images of minors, express authorization from the legal guardian is mandatory.

4. RESPONSIBILITIES AND ACCESS TO SERVICES

4.1 Third Parties:

The Developer is not responsible for failures or interruptions of services provided by third parties (for example, internet access providers or technology partners).

5. RELATIONSHIP WITH THIRD-PARTY PROVIDERS

5.2 Access Devices:

If you access Apptismo Services through third-party applications or platforms (for example, via app stores such as APP STORE™ or Google Play™), your access will be subject to the terms of these providers, which are not incorporated into this Contract.

6. ACCOUNT AND REGISTRATION

6.1 Account Creation:

To use Apptismo Services, you must create and maintain an account (Account), providing accurate and updated personal information, such as name, email, phone and, if applicable, patient information.

7. WARRANTY DISCLAIMER

7.1 "As Is" and "As Available":

Apptismo Services are provided "as is" and "as available", without specific warranties regarding performance, continuous availability or absence of errors, except those expressly provided in these Terms. All risk arising from the use of the Platform is the User's, to the extent permitted by law.

8. LIMITATION OF LIABILITY

8.1 Limitations:

The Developer will not be responsible for any direct or indirect damages (including lost profits, losses and data, service interruption, moral or property damages) arising from the use or inability to use Apptismo Services, except in cases of proven intent or fault, limiting such damages to the amount eventually paid by the User.

9. INDEMNIFICATION

You agree to defend, indemnify and hold the Developer and its representatives harmless from any claims, damages or expenses arising from your improper use of the Platform, violation of these Terms or any applicable laws.

10. INTELLECTUAL PROPERTY AND CONTENT

10.1 Application Content:

All content (images, texts, trademarks, graphics, etc.) made available in Apptismo is the exclusive property of the Developer, being protected by intellectual property laws.

11. CONDUCT AND PROPER USE

11.1 Behavior:

You commit to using Apptismo ethically and responsibly, refraining from:

Declaring affiliation or endorsement of the Developer without authorization;
Conducting advertising or commercial activities without consent;
Inserting or transmitting viruses, malware or any malicious code;
Collecting or disclosing personal information of other Users without authorization;
Interfering with the Platform's operation or integrated third-party services;
Creating fake profiles or acting fraudulently;
Using communication channels (such as chat) to disseminate illicit information or that violates others' privacy.

13. PAID FEATURES

13.1 Premium Features:

Some Apptismo features may be made available for payment. By purchasing these features, you agree to the specific payment terms and applicable conditions.

14. PAYMENTS

14.1 Secure Processing:

Payments will be made through secure methods. You must provide accurate information and keep your data updated.

15. USER RESPONSIBILITIES

15.1 Voluntary Use:

By using Apptismo, you declare that you do so of your own free will, fully accepting these Terms.

16. TERMINATION OF RELATIONSHIP

16.1 Termination by User:

You may terminate your relationship with the Developer at any time by requesting deletion of your Account, which can be freely requested within the application or by uninstalling the application. After deletion, all associated data will be permanently removed.

17. OTHER CONSIDERATIONS

17.1 Platform Modifications:

The Developer reserves the right to modify, update or discontinue Apptismo features at any time, without prior notice.

18. CHANGES TO TERMS OF USE

18.1 Modifications:

These Terms may be changed at any time by the Developer. It is recommended that you periodically check this section to stay informed about any changes. Continued use of the Platform after publication of changes constitutes acceptance of the new terms.
